Water Activities – Guadeloupe: Local Guide

General Rental Terms

• In the event of unfavorable weather or navigation conditions, Bluesoley reserves the right to cancel any service and proceed with a refund to the customer.
• A rental contract will be signed by the applicant, hereinafter referred to as "the renter," before the equipment is made available.
• The rental of the equipment is granted for a specified duration and number of people per boat as stated in the contract.
• Full payment for the service must be made no later than upon the return from the activity.
• The rental company is not responsible for the conditions under which the renter uses the equipment.
• The rental company is not responsible for vehicles parked on-site or items entrusted to it.
• The rental company does not guarantee the waterproofing of any loaned bags.
• An identity card or check will be required as a security deposit.

Obligations of the Rental Company

The rental company agrees to :

• Provide all necessary explanations about the activity and the planned route.
• Subscribe to insurance covering its civil liability.
• Not rent to any minor under the age of 6.
• Not rent to any minor alone, unless accompanied by a responsible adult.
• Have each participant certify, on their honor, the ability to swim 25 meters and be capable of immersing themselves.
• Inform the renter of the importance of respecting wildlife, flora, and private properties, and ensure no waste is left in the environment during the entire rental period.
• Inform the renter of all obligations outlined below.

Obligations of the Renter

The renter agrees, and possibly on behalf of all participants they represent, to :

• Ensure that each participant can swim 25 meters (under 16 years old) or 50 meters (16 years old and older) without flotation assistance and has no medical contraindications to practicing Kayaking, Pedalo, or water activities such as Kitesurfing or Wingfoiling.
• Ensure that each person wears a flotation aid (Kayak only) throughout the activity.
• Not exceed the 300-meter zone, not navigate in swimming areas, and not park in channels.
• Return all equipment involved in this service to the rental company in its original condition.
• Possess the knowledge and experience necessary for the planned navigation, according to the conditions specified.
• Respect wildlife and flora, refrain from abandoning their water sports equipment and waste along the route, and avoid entering private properties where access is prohibited.
• Be aware of the upcoming weather conditions and any relevant safety instructions and regulations for these activities.
• Carry a working phone during the activity to communicate with Bluesoley if necessary.
• Follow navigation instructions and respect other users, signage, and regulations posted at the rental point.
• Understand that failure to respect the navigation area, instructions, signage, or any posted regulations will result in the immediate cancellation of the rental without a refund.
• Accept that photos in which they or their group appear, even if minors are involved for whom they have assumed responsibility in this document, may be used solely for professional purposes by the rental company.
• Pay, in case of an incident, for the repair, intervention, or replacement of the equipment as per the unit prices listed below in the event of damage or loss.
